What should I pay attention to when deciding on the execution of a power of attorney and its issuance?

The form of a power of attorney may be an ordinary written or a notarial written form. A notarized power of attorney is required for a transaction that requires notarization in cases provided for by law or by agreement of the parties.
The text of the power of attorney must indicate the place and date of its preparation (signing), last names, first names, patronymics (full name of the legal entity), place of residence (location of the legal entity) of the representative and the represented person, and, if necessary, the position they hold. Powers of attorney addressed to lawyers indicate their status and membership in a lawyer association (if the lawyer is a member of a lawyer association). It should be pointed out that the current legislative acts of Ukraine do not provide for the requirement to indicate in the power of attorney the passport data of the principal and the authorized person.
The power of attorney must indicate the powers to which the representative is authorized. It should be noted that a "general power of attorney", that is, a power of attorney to perform the widest possible range of actions, is not recommended for sole proprietors and legal entities. Since FLP must conduct business activities personally. And for a legal entity, the presence of a general power of attorney is one of the signs of control by such a representative, in particular, from the point of view of legislation.
Cancellation of power of attorney. With the termination of representation under a power of attorney, the substitution becomes invalid, and the representative is obliged to immediately return the power of attorney. One of the grounds for termination of representation by proxy is its cancellation. The person who issued the power of attorney and subsequently cancelled it must immediately inform the representative, as well as third parties known to him, for the representation of whom the power of attorney was issued. The rights and obligations in relation to third parties that have arisen as a result of the transaction by the representative before he knew or could have known about the cancellation of the power of attorney, remain valid for the person who issued the power of attorney and his successors. This rule does not apply if the third party knew or could have known that the power of attorney had expired.
