What clauses should be included in any contract?

yaki-zasterezhennya-potribno-vklyuchati-v-bud-yakij-dogovir According to Art. 628 of the Civil Code of Ukraine, the content of the contract consists of conditions (clauses) determined at the discretion of the parties and agreed upon by them, and conditions that are mandatory in accordance with acts of civil legislation. According to Article 630 of the Civil Code of Ukraine, a contract may establish that its separate conditions are determined in accordance to the typical terms of contracts of a certain type. If the contract does not contain a reference to standard terms, such standard terms may be applied as a custom of business turnover if they meet the requirements of Article 7   of the Code.

According to Art. 7 of the CCU, civil relations may be regulated by custom, in particular by the custom of business turnover. A custom is a rule of conduct that is not established by acts of civil legislation, but is established in a certain area of civil relations. The custom may be recorded in a relevant document. A custom that contradicts a contract or acts of civil legislation is not applicable in civil relations.

So that there are no problems with the counterparty regarding issues that seemed insignificant and understandable to everyone, it is better to highlight these nuances in the contract.
