How to write a leave application?

An application for leave is submitted to the employer to register a legal absence from work. It must meet the requirements of the current labor legislation of Ukraine, as well as the internal rules of the enterprise. In this article, we will consider how to correctly write an application for vacation , what are its mandatory details.

According to Art. 74 Labor Code , every employee has the right to an annual basic paid vacation lasting at least 24 calendar days . In addition, the employee may have the right to additional types of leave ( maternity , educational, social, without salary).

Annual basic and additional full-time vacations in the first year of work are granted to employees after six months of continuous work at the enterprise , institution or organization. If leave is granted before the end of this six-month period, its duration is calculated in proportion to the time worked. Exceptions are cases defined by law, when the employee has the right to receive a full-time vacation at his own request. Starting from the second year of work, employees can take annual leave at any time of the working year .

The duration of vacation is calculated in calendar days, regardless of the schedule or mode of work. Holidays and non-working days are not included in the duration of annual leave . Additional annual leave at the employee's request can be used together with the main leave or separately. The total duration of annual basic and additional vacations should not exceed 59 calendar days . For workers engaged in underground mining, this limit is 69 calendar days.

The legislation of Ukraine does not require an employee to submit an application if he plans to take a vacation within the terms approved by the company's vacation schedule. In this case, the employer can issue an order based on the vacation schedule itself. However, if the employee plans to change the vacation time, choose a different period or take only part of it, he must contact the management with an application . In such a situation, changes are possible only upon agreement with the employer.

The main elements that make up the application :

  • "document header" (name of the company, name and position of the manager, name and position of the employee);
  • the main text, in which the request for leave is indicated, its type (annual, educational, at own expense, etc.) and the leave period (start and end date) are indicated;
  • date and signature of the applicant.

The head of the enterprise, upon receiving the employee's application , confirms his consent to leave on the specified dates by affixing his signature. If necessary, given the circumstances, the manager can offer to postpone the vacation to another period. Based on the agreed application, an order (or order) is issued to grant the vacation .
