What do you need to pay attention to when making a decision on the execution of a power of attorney and its issuance?

The form of power of attorney can be ordinary written or written notarized. A notarized power of attorney is required for the execution of a transaction that requires notarization in cases provided for by law or by agreement of the parties.
The text of the power of attorney must indicate the place and date of its drawing up (signature), surnames, first names, patronymics (full name of the legal entity), place of residence (location of the legal entity) of the representative and the person being represented, and, in necessary cases, the position they occupy Powers of attorney in the name of lawyers indicate their status and membership in the bar association (if the lawyer is a member of the bar association). It should be noted that the current legislative acts of Ukraine do not provide for the requirement to indicate the passport data of the principal and the authorized person in the power of attorney.

It should be noted that it is not recommended to issue a "general power of attorney", i.e. a power of attorney for the widest possible range of actions, for sole traders and legal entities. And for a legal entity, the presence of a general power of attorney is one of the signs of control by such a representative, in particular from the point of view of legislation.
Cancellation of power of attorney. With the termination of representation under a power of attorney, the remandation becomes invalid, and the representative is obliged to immediately return the power of attorney. One of the grounds for termination of power of attorney representation is its cancellation. A person who issued a power of attorney and subsequently revoked it must immediately notify the representative, as well as third parties known to him, to whom the power of attorney was issued for representation. The rights and obligations towards third parties that arose as a result of the deed being committed by the representative before he learned or could learn about the cancellation of the power of attorney remain valid for the person who issued the power of attorney and his successors. This rule does not apply if the third party knew or could have known that the power of attorney has ceased.
