Players on the gas market: who are they?

The gas market has the following levels of entities:

Suppliers:

• Just suppliers
• Suppliers with special obligations - "obligated" - they were identified in the list in the resolution of the CMU of October 2015.
• Guaranteed suppliers - this status is not in the Law on the gas market, but the 2012 decree remained in force, so everyone who had a license for supply at an unregulated tariff is considered a guaranteed supplier . Oblgazzbuty received such licenses just before the entry into force of the new law.
• The supplier of "poslednei nadezhda" is Neftegaz

Transport organizations:

• UTG - highway transportation
• "oblgazy" - network transportation and capacity distribution

 

Why is it possible to assume that Oblgazbutov actually does not have licenses:

1. Since 01.01.2015, the concept of "gas supply at a regulated tariff" is absent.
2. From October 1, 2015, gas supply activities are carried out under valid licenses issued before the entry into force of the Law on the Gas Market within 3 months after the approval of new license conditions (Clause 6 of the Transitional Provisions of the Law of Ukraine "On the Natural Gas Market"), BUT not what exactly are "active licenses" written (it is possible to read "licenses" for absolutely any type of activity). Until October 1, 2015, there was a requirement for "gas supply licensing at a regulated tariff", not "supply licensing".
3. The above is confirmed by Clause 2 of Art. 8 of the Law on Licensing, according to which in case of cancellation of licensing of a type of activity, the licensing body loses the powers of the licensing body, and licenses issued for the implementation of this type of activity are considered invalid , i.e. all licenses for the supply of gas at the regulated tariff are invalid.
4. P. 3 was confirmed by a letter from the NCRECP itself.
5. In the absence of license conditions, responsibility for conducting activities of the licensed type without a license does not apply (Article 20 of the Law on Licensing). Licensing conditions for the supply of gas at a regulated tariff are still valid.

7. On 01.09.2015, the NERC ordered to reissue licenses for the supply of gas at regulated tariffs for indefinite periods at the request of licensees, at the same time, recently issued licenses were declared invalid, while in paragraph 1 of the Resolution it is written that the license, for example, "Zaporizhgaz Sbyt" LLC No. 299031 will be reissued, and in clause 2 of this same resolution "license No. 299031 shall be declared invalid ."
8. For example, State Enterprise "Gaz Melitopol" PJSC "Melitopolgaz" http://dpmelgaz.com.ua/ does not say at all that they are guaranteed or any other suppliers and that they at least once had a license.

 

Customer relations with regional gas services

The consumer enters into a contract with regional gas distribution by joining, namely by using gas, this action of the consumer means his full agreement with the terms of the contract.

The peculiarity of regional gas utilities as suppliers with special obligations is that if the consumer does not have a second nominated volume under the contract with the second supplier, then he automatically consumes gas of the regional gas utility. In order to conclude an agreement with the second supplier, the consumer must refuse the gas of the supplier with special obligations, for which he must submit an appropriate application according to the Rules for the supply of natural gas.

At the same time, it can be concluded that gas is transferred to consumers at the exit point, because the population pays "for gas and services" on the accounts of regional gas utilities, and in general the tariff consists of a tariff for gas itself, a tariff for transport and a tariff for power distribution, and regional gas utility pays UTG and gas distribution enterprises for transportation.
